Responsibilities
GENERAL PURPOSE:
Under general direction of the Associate Director for Scholar Services, with latitude for individual judgement, provides immigration advice on how to hire international employees and scholars to the University. Manages the processing and filing of employment-based petitions (H-1B, Specialty Occupation Worker and TN, Trade NAFTA) and J Exchange Visitor Program. Advises on O-1, Extraordinary Ability Worker employment-based filings, waiver of two-year home residence requirement, and routes to permanent residence. Works with VP for Recruitment of MD¿s, Clinical Chairs, and outside immigration counsel. Coordinates support for international population throughout the University and the departments that host them. Works with USCIS (US Citizenship & Immigration Services), USDOL (US Department of Labor), USDOS (US Department of State), SEVIS (Student & Exchange Visitor Information System), and Sunapsis Database, U of R Departments, and senior leadership.
RESPONSIBILITIES:
Immigration Regulatory Compliance
- Serves as an immigration advisor to hiring departments, employees, and scholars and advises on complex immigration requirements, permissions, benefits, applications, and procedures on employment based nonimmigrant statuses, H-1B, J EVP, TN, F-1OPT (Optional Practical Training) and F-1OPT STEM, and O-1. Determines appropriate status for the situation.
- Determines prevailing wage, actual wage, and required wage to prepare and file LCA¿s (Labor Conditions Attestation). Files LCA¿s with US Dept. of Labor, following USDOL Regulations. A certified LCA is required to file H-1B petitions.
- Prepares H-1B petitions, also submits accompanying H-4 applications, and files with USCIS following Immigration Regulations
- Ensure institutional SEVIS and USCIS compliance by adhering to government reporting requirements and deadlines.
Immigration Advising
- Advise hiring departments, employees, and scholars on complex immigration requirements, permissions, benefits, applications, and procedures on employment based nonimmigrant statuses, H-1B, J EVP, TN, F-1OPT and STEM, and O-1. Determine appropriate status for the situation.
- Manage J EVP and produce documents and provide orientation.
- Strategize on best route to permanent residence for international employees. Advise departments and international employees and coordinate with outside immigration counsel.
- Counsel and triage employee concerns, anticipating potential immigration consequences or opportunities, and make appropriate resource referrals.
- Review waiver process with J EVP¿s.
- Review waiver process for MD hires who have been sponsored by ECFMG¿s (Educational Commission of Foreign Medical Graduates) J program
- Work with VP of MD recruitment and immigration. Determine best nonimmigrant status for hire, best process to obtain a waiver, and best route to permanent residence for MD.
- Design and deliver orientation programs for scholars and dependents
- Advise dependent spouses/partners and children on immigration permissions, responsibilities, resources, etc.
- Advise international scholars on travel issues and visa stamp renewals
Data Management and reporting
- Manage J EVP in SEVIS and Sunapsis. Producing DS -2019 forms
- Maintain and updates employee and scholar information in Sunapsis database and government SEVIS system
- Manage various immigration alerts in Sunapsis
- Provide content expertise while working with Systems Team and Associate Director, to design and develop:
- E-forms and Checklists in Sunapsis and client facing portal
- Train department and scholars on client facing portal
- Maximize the utilities of Sunapsis Database
- Produce reports as needed from Sunapsis, i.e.: renewal reports
- Develop procedures for going to and maintaining paperless files while still needing to submit paper to government agencies.
Training and Administration
- Supervise student employee to assist with Sunapsis, scanning, and going to and maintaining paperless files.
- Answers Scholar Questions email. Review, triage requests, and provide answers.
- Develop and present H-1B, J EVP, TN, Routes to Employment sponsored Permanent Residence, J EVP, and Sunapsis training sessions for departments and scholars throughout the University.
- Submits international scholar names to Visual Compliance for background check
- Responsible for immigration renewal process notification to department administrators and scholars regarding status expiration, explaining renewal process and following up for required documentation.
Other duties as assigned
QUALIFICATIONS:
- Bachelor¿s degree required
- Master¿s degree preferred
- Minimum 2 years¿ relevant immigration experience required or
- equivalent combination of education and experience required.
- Knowledge of employment nonimmigrant statuses, J-1 Exchange Visitor Program regulations, routes to employment sponsored permanent residence, and government SEVIS system, US Dept. of Labor, US Immigration, and US Dept. of State regulations. Excellent communication, interpersonal, and organizational skills required.
- Experience with Sunapsis and a medical center preferred.
- Per federal regulations, to be an Alternate Responsible Officer with responsibilities for the J Exchange Visitor Program, U.S. citizen or permanent residence is required.

Pay Range
Pay Range: $24.91 – $34.87 Hourly
The referenced pay range represents the minimum and maximum compensation for this job. Individual annual salaries/hourly rates will be set within the job¿s compensation range, and will be determined by considering factors including, but not limited to, market data, education, experience, qualifications, expertise of the individual, and internal equity considerations.
